January 10th is coming soon and I need your help

The deadline to file my response to the lawsuit filed against me made by Sturgis North, Ray Sasseville and Joan Hansen is January 10th, 2014. As of today's date I have raised $1,620.00 with promises of 2 cheques in the amount of $500 each being in the mail.

For this first round of this suit I need to raise $5,000.00.  I want my day in court to face Ray and Joan and prove that what I have had to say is true. That what I have gathered for evidence shows a certain pattern of behaviour.  I want the documents I have becoming public record, I want to clear my name and protect my community.

I have come, helmet in hand to ask the motorcycle community to help me defend myself.

For those of you who don't know the history of Sturgis North here is a quick glance at what has transpired since the first event held in 2011.  The first event was a financial failure and faced a number of challenges because of the way the venues were laid out, communications and organizational issues. Depending on which set of documents you read, the debt from 2011 was between $200,000 and $975,000

2012 - the event moved to Vernon's Motoplex and was again a financial failure, the venue was terribly laid out and it again had communication and organizational issues.
To visit Vendor Alley you had to pay $20
The liquor control board put huge sanctions on the beer gardens.
The BEU was everywhere.
The 2012 event left close to $400,000 in debt.

The 2013 event was cancelled and during the down time it was rebranded it to Sturgis Canada.

I started out as a supporter and sponsor of the event. I became a detractor about 2 minutes after I rode into the Motoplex venue the second year when I saw how things were laid out.

I started investigating the event and the policing situation after having gotten some emails from unhappy people asking for help over the policing situation.

As it turned out, that investigation took some serious turns and I learned a lot of things that made me uncomfortable about Ray Sasseville in particular.  
I published some of those the findings here in my blog and again in our newspaper the Busted Knuckle Chronicles.

Because I have again brought their event to the fore front of people's minds, reminding them of the history, I am being sued along with 6 others for slander, libel and defamation.

Next to being reduced to asking for financial support for my defense, having to revisit all of the evidence I have, is the most painful thing I have had to do in a while, but I have been doggedly working to pull it all together into a chronological format for the lawyer.

I decided to revisit some of lawsuits against the above mentioned parties after reading Martha Wickett's articles in Salmon Arm Observer the other day to see if anything new had transpired.
I sent my research assistant off to retrieve the documents on the Ministry of Justice web site.

Besides the case Sasseville et al have initiated against myself and 6 others, there are lawsuits that were initiated by Michael Smith, Warren McKay, Okanagan Aggregates, Robert Lopez,and Marjorie Paula Sasseville that are still active and a couple that were withdrawn or dismissed and one that indirectly involves Sturgis North. As I read the documents of the Michael Smith case over, my memory was refreshed and I realized I had known about this case, I had just forgotten it.

And as Martha Wickett stated in her article, Michael won his lawsuit by default judgment on August 16th, 2012.

The next lawsuit Martha alluded to; the Motoplex one:
Okanagan Aggregates DBA Motoplex Speedway is suing Sturgis North Encore Productions, Ray Sasseville and Joan Hansen for $398,567,34. According to the documents, on July 20th, 2012 the plaintiff agreed to advance the defendants $539,023, on the 25th of July 2012, the amount advanced had been reduced to $454,11.72. A guarantee had been signed by both Sasseville and Hansen.
The plaintiff recovered some of the money that had been advanced, leaving the outstanding debt at $398, 567.34.

Sturgis North 2012 was held July 18-23, 2012.

Ray, Joan and Sturgis North Encore Productions Inc are counter suing and allege that they never had an agreement with Okanagan Aggregates regarding the advance of funds. They also claim, among other things, that the Motoplex took all of the ticket sales money and converted it for their own use.
They want the judge to dismiss the Motoplex suit.

And I did discover something new - a lawsuit filed by one Marjorie Paula Sasseville filed on Feb.12th, 2013.

Whoever this Marjorie Paula Sasseville is, Ray's wife Edith, has power of attorney for her.  And Ray's wife on behalf of Marjorie, as Power of Attorney,  is suing Ray for $140,000.00 alleging that Ray signed a promissory note for $140K at 12% interest.  What is most interesting to me is that Marjorie lives at the same address as the plaintiff.  Interestingly enough, it is the same address that has always been identified as Ray and Edith Sasseville's home address.

Thanks to you all...

I want to thank everyone who has donated to my defense fund so far.

Because of you, my husband and I were able to have a reasonably peaceful Christmas.

The Sturgis North Entertainment, Ray Sasseville, Joan Hansen suit alleging slander, defamation and libel against me was pushed aside for a few hours because of your comments of support and for those who could, their donation.  Knowing I have the support of my community made a huge difference in the day.

It had been suggested that I put up a donation thermometer so that people could see how close to the goal I am.

Right now, beyond the retainer and some immediate support staff help, I have no idea what the goal should be.

I can tell you that I have raised close to $1,500.00 so far and have been promised 2 -  $500 donations to come by mail.  I know that I will need about $5,000 for my share of the lawyer initially and that I have to pay other people to do research gathering, and time line creation.

I know how much time of mine this is consuming and how it means that other things that I have to do are falling farther and farther behind, and because of my crash in October, they were already behind.

I have no idea where I go after getting through this initial time.

Is $10K the right amount to attempt to raise?
Is 20K and what happens if I raise more than I need.

What then?

I have no idea - none.

I know that my sales are suffering as is my invoicing etc. I know that proposals I have to do are suffering.  All I can do is deep breath and work as steady at it all as I can for as many hours every day that I can.

If anyone has time to help here in Grande Prairie, I could sure use the donation of a few hours of your time! It's tedious and time consuming work reading through the gathered evidence, chronicling it all and having to revisit all of those feelings.  It's a total nuisance that is taking up time and resources that could be put to better use else where. But it is what it is and somehow, I will find a way to meet all my deadlines and keep on keeping on. I just have to.

The BEST Christmas Present EVER!

When I got the papers for the lawsuit served to me last Friday a number of things went through my head.

Like many things in life, there are phases of emotions and thought patterns that we all go through.

My very first thought was:
How the hell do I tell my husband?
MS patients do NOT need worry in their lives, that only accelerates the disease's progress.

Then I wondered do I keep this to myself, or do I do the right thing and report on what is going on after all, it is Canadian motorcycle community news and the documents are public record.
Do I announce it to the world and risk loosing advertisers who may not know the whole story?

After those thoughts rolled through my brain, others started flooding me...

Why aren't the other reporters who have been following and reporting on this story been sued?
Why am I included in a lawsuit with so many others?
I thought to myself, why would Sturgis North (which is now Sturgis Canada), Ray Sasseville and Joan Hansen really want to sue me?  They know that my business is just a little community based business and that I really don't have anything, so why? Do these people really consider me a threat?

These are but a few of the questions that have rolled around in my head.

Then came that self pitying time.

I'm barely recovered from my motorcycle crash and the costs of that and now this, throwing good money after bad to defend myself. What a nuisance!

Then a calm settled over me.

I decided to listen to my gut and just put the facts out there the way I have done with everything I report on and to ask this community for help.  As that decision settled in my heart, the gut wrenching emotions went away. I was able to get down to the business of gathering the facts.

After I talked to one lawyer friend and sought some initial advice, I spoke with some of the other defendants and began the work of going through the list of the people I had interviewed to do my initial pieces on Sturgis North and Ray Sasseville.

I revisited emails, started copying and filing things for the lawyer.
I did google searches to find all the articles I have done and I uncovered even more news about Sturgis North and Ray Sasseville.

Then I asked my web mistress to build me a defence fund page and link as much of the information as possible all in one place.

On the Belt Drive Betty Defense Fund Page you will be able to read my blog posts, the comments made by others and my responses.
You will be able to see the four pages of the legal documents that pertain to my involvement in this law suit.
And I made a video to explain how I feel about the Sturgis North, Ray Sasseville, Joan Hansen lawsuit against me.

On the Defense Fund page, I offer you the facts as I know them, links to information and ask you to form your own decisions.
(There is so much that I cannot share publicly, the private emails from people asking me for help over money owed to them, the documents that were shared with me, the phone calls from hurt and angry people - all of this needs to stay privileged until they come out in court.)

Then I swallowed my pride and asked you, my community, to support me.

I have already received a number of donations and I am deeply appreciative and blown away by that.
I have received emails, Pm's and phone calls from people willing to swear out affidavits.
I have received emails and letters of support from people who cannot afford to donate to the defense fund but are sharing the story far and wide because they believe in me.

The support and comments have eased my husband's mind immeasurably and they have warmed my heart. It is deeply gratifying to know that the work I do for this community answers a need and really adds value to people's lives.  That alone has made my heart lighter.

I slept really well for the first time in a while, last night.  It's amazing how when you are angry, the sleep you get never makes you feel rested or ready to tackle the day.

To every individual who helps me, I want you to know one thing:
The help you give me today - I SWEAR TO YOU I WILL PAY FORWARD into our community 10 fold.

A Christmas present I could have done without.

Yesterday as I was editing some video a knock came at the back door.

It was a process server; surprise, surprise, Ray Sasseville, Joan Hansen and Sturgis North Entertainment Inc. are suing myself and six others.

The civil lawsuit document is 30 pages long, all of the "defendants" are basically charged with libel, defamation and slander and the plaintiffs claim that we have caused them financial hardship among other things.

Some of the other "defendants" are individuals or associations I am familiar with, others I have never met or heard of before yesterday, but we are all being sued in one lawsuit.

I called my lawyer who asked me to scan the documents and email them to him along with a document that should contain my answers to the charges made against me.

My lawyer is already in possession of the document and my answers to the "charges" against me, but I have to compile everything into a timeline which is going to take me month to complete as that is how much paperwork I have to go through.

As I worked to provide my lawyer with the things he needs to file my response to the suit from Sturgis North, Ray Sasseville and Joan Hansen, I came across this little tidbit published a few days ago: http://finance.yahoo.com/news/securities-regulator-issues-notice-hearing-230400248.html

The BC Securities Commission is holding a hearing in January, 2014 where in they allege that Ray Sasseville, his wife Edith and a man named Richard Keller illegally distributed convertible debentures without having filed a prospectus or being registered with the BC Securities Commission.

Now, Ray himself is already considered a "Disciplined Person" by the BC Securities Commission over a similar situation involving a different company.  You can read about the Disciplinary Action taken by the BCSC against Ray Sasseville by clicking here.

During his first brush with the BC Securities Commission, when he paid a $10,000 fine and was banned from trading for 3 years, Sasseville was "educated" to the fact that in order to sell or distribute convertible debentures that he needed to file a prospectus and be registered with the BCSC.
That was in 2003. This current hearing involves trading that happened from 2007 to 2008.

It was very fortuitous coming across this information yesterday because among the claims Ray and his counterparts are making against me is that:
48.      Apart  from the defamatory and libelous  meaning  of the Defendants' publications as set out above, it carries the additional sting that the Plaintiffs are:
             (a)        not law abiding citizens or a corporation that operate outside the parameters of the law;
(b)       without any moral fibre;
(c)        not trustworthy;  (d)         illiterate;
(e)       incompetent; and

(f)        underhanded

In questions to Hansen, the Observer referred to two civil claims involving Sturgis North – the one initiated by the motoplex, as well as one initiated by Michael Smith – not the Smith who helps run the Summer Stomp motorcycle event – versus Ray Sasseville and Sturgis North Promotions 2011 Inc. In an Aug. 13, 2012 judgment, the court ordered that Sasseville and Sturgis pay $70,000 plus interest and costs to Smith. Smith could not be reached for comment. End Quote

My defence is simple:

Fair Comment
A form of qualified privilege applied to news media publications relating to discussion of matters that are of legitimate concern to the community as a whole because they materially affect the interests of all the community. A term used in the defense of libel actions, applying to statements made by a writer (e.g., in the news media) in an honest belief in their truth, relating to official acts, even though the statements are not true in fact. Fair comment must be based on facts truly stated, must not contain imputations of corrupt or dishonorable motives except as warranted by the facts, and must be an honest expression of the writer's real opinion.

In my case, nothing I have dug up is untrue.
Nothing I have said is untrue.
And as always, my goal as a reporter is to educate and inform; to provide people with the information they need to make their own decisions about whether or not they want to participate.

I am deeply concerned over the costs this nuisance suit will level on the resources of my small community based business. The time and money it is going to take to defend myself is nothing short of mind numbing, however, I have never been one to back away from a challenge.

Don't be surprised if I come to you, my community, asking for some help though, because if this thing drags out, it is going to hamper my ability to keep helping the riding community.

So there you have it, the information on the Christmas present I could do without...

Some information on the legal definitions of the following terms that you might find enlightening:

Defamation
Any intentional false communication, either written or spoken, that harms a person's reputation; decreases the respect, regard, or confidence in which a person is held; or induces disparaging, hostile, or disagreeable opinions or feelings against a person.

Libel 1) n. to publish in print (including pictures), writing or broadcast through radio, television or film, an untruth about another which will do harm to that person or his/her reputation, by tending to bring the target into ridicule, hatred, scorn or contempt of others. Libel is the written or broadcast form of defamation, distinguished from slander which is oral defamation. It is a tort (civil wrong) making the person or entity (like a newspaper, magazine or political organization) open to a lawsuit for damages by the person who can prove the statement about him/her was a lie. Publication need only be to one person, but it must be a statement which claims to be fact, and is not clearly identified as an opinion. While it is sometimes said that the person making the libelous statement must have been intentional and malicious, actually it need only be obvious that the statement would do harm and is untrue. Proof of malice, however, does allow a party defamed to sue for "general damages" for damage to reputation, while an inadvertent libel limits the damages to actual harm (such as loss of business) called "special damages." "Libel per se" involves statements so vicious that malice is assumed and does not require a proof of intent to get an award of general damages. Libel against the reputation of a person who has died will allow surviving members of the family to bring an action for damages. Most states provide for a party defamed by a periodical to demand a published retraction. If the correction is made, then there is no right to file a lawsuit. Governmental bodies are supposedly immune for actions for libel on the basis that there could be no intent by a non-personal entity, and further, public records are exempt from claims of libel. However, there is at least one known case in which there was a financial settlement as well as a published correction when a state government newsletter incorrectly stated that a dentist had been disciplined for illegal conduct. The rules covering libel against a "public figure" (particularly a political or governmental person) are special, based on U. S. Supreme Court decisions. The key is that to uphold the right to express opinions or fair comment on public figures, the libel must be malicious to constitute grounds for a lawsuit for damages. Minor errors in reporting are not libel, such as saying Mrs. Jones was 55 when she was only 48, or getting an address or title incorrect. 2) v. to broadcast or publish a written defamatory statement.

Slander n. oral defamation, in which someone tells one or more persons an untruth about another which untruth will harm the reputation of the person defamed. Slander is a civil wrong (tort) and can be the basis for a lawsuit. Damages (payoff for worth) for slander may be limited to actual (special) damages unless there is malicious intent, since such damages are usually difficult to specify and harder to prove. Some statements such as an untrue accusation of having committed a crime, having a loathsome disease, or being unable to perform one's occupation are treated as slander per se since the harm and malice are obvious, and therefore usually result in general and even punitive damage recovery by the person harmed. Words spoken over the air on television or radio are treated as libel (written defamation) and not slander on the theory that broadcasting reaches a large audience as much if not more than printed publications.

My new heroes - Josie the Outlaw & Veteran and Police officer Aaron Weiss

I recently came across a series of videos from a gal called Josie the Outlaw and I have to tell you - this young lady has some solid, solid arguments and solid ideas. She is eloquent, thoughtful and sharp and her messages are important, powerful and urgent.

Now this might be an American gal delivering this message but her message is universal and applies to us here in Canada far more than one would like to admit.

I found it very hard to punch holes in her commentary anywhere in any of the four videos I have watched and I think you will have the same difficulty. The only difficulty I had was who does stop the bad guys if there is no authority structure.  I wonder if in future videos she will address that one issue.

After I watched her videos, I came across this one, also American and also super relevant to what is happening here in Canada:



I truly believe that this soldier, Arron Weiss and Josie the Outlaw are two of the brightest lights in the work to restore and keep our freedoms and rights.

These people are saying the things that so many think.

Look at the G 20 Summit in Toronto and the complaints of police brutality, or the recent information about the eavesdropping by our government...by the American government, the Chinese government

Taking a stand to remove people like Police Chief John Hagarty from positions of authority and power is how every person can make a difference. It is our DUTY to protect our rights and freedoms as a community and I call on every rider within my circle to take that stand - to stand up and be counted. To stand shoulder to shoulder with the Kawartha Charity Riders and every other rider who has ever experienced profiling, discrimination and oppression by a member of the police services.

The police officer in the article linked below is an example of what is wrong with the police services across this country and sadly there are many more just like him; Monty Robinson is probably one of the most publicized example of what is wrong with the system the culture they work in:

I urge you to become a Good Outlaw.

By uniting your voice with others we force our voices to be heard, creating that groundswell of support for those who are oppressed by narrow minds. It is only by holding those in authority accountable, making them answer to us - their boss - we the people, that we can affect any kind of positive change right now.

It is my hope that the motorcycle community will stand shoulder to shoulder to protect our rights and freedoms.

And remember:
Just because YOU haven't experienced discrimination or harassment yet,
does not mean it isn't happening and doesn't need to be stopped.

Please take a few minutes to examine your heart and your conscience.

And then help us Remove Police Chief John Haggarty from his position of authority.

A scam or???

Your Favourite Motorcycle Rally is Back!

When we postponed the rally in 2013, we know many were disappointed.  

Why did we do it?

We needed a year off to re-create the festival and we are now Sturgis Canada! The new brand reflects the international growth of our event.

The Sturgis Canada Rally will take place August 21-24, 2014 in Merritt, BC, Canada.  We've partnered with the city to utilize the former site of the Merritt Mountain Music Festival and are proud to launch Sturgis Canada in a city known for its love of music and warm, friendly community.   Merritt officials are fully supportive and our team of Canadian and US organizers include the best and the brightest.

Get ready for three stages of live music, action-packed activities and ample on-site camping. 

Be prepared for an A-list line-up of bands.  To date, we have Jasmine Cain of Sturgis, South Dakota/Nashville, Tennessee (voted three time North American Female Rocker of the Year), personalities like Rick Dakota, Kimmy Cruz and Jack Schit, and motorcycle traditions that include Bike Games, Burnout Competitions and a Battle of the Bands organized by Supernova Music.

I have to say that no matter where this rally is held, as long as Ray Sasseville or Joan Hansen are involved in ANY WAY - I will NEVER attend.  
Too many people that I care about have been hurt for me to feel any level of trust.
